You are absolutely right. These frauds need to be stopped. Because of this fraud H1b quota is used up on the very first day and EB3 India has a backlog of seven years. If USCIS weed out all the frauds, I bet the wait for EB3 india will be no more than 3 years.
You are already out of status as H1 accounts for continuous employment along with regular pay. H1 visa, job and pay go hand in hand. Any one component missing means you are out of status.
There is no grace period. As the earlier member said, it is a gray area without any specific guidelines. I have seen people stay out of job (status) for 4 months and have used portability or consulate stamp upon getting a new job. It all depends on the IO.
BTW, did you ever realize how unethical it is to use a consultant for acquiring a H1 visa without actually having a fulltime job? For last 7 years I am on H1 myself and have played by rules� I hate people who false represent the facts for immigration benefits.
Because of people like you genuine candidates who have legitimate jobs are left out as you guys get lucky in the lottery even though you don�t have a regular fulltime job. My wife was forced to stay at home for almost 3 years because of people like you.. FYI she had a job offer (from a F500 Inc.) but people like you got lucky when it came to H1 lottery. Not just that but people like you give a bad name to legal immigrant community.

Everyone here on this forum understands the frustration of H4 limitations.
However, to say that IV has not done anything beyond media publicity is far from truth.
I hope that you read the "Amendments" link on the homepage(top).
These amendments sponsored by Sen. Brownback and co-sponsored be Sen. Alexander and Bingaman DID NOT HAPPEN AUTOMATICALLY.
And they did not come from other organization or lobbying firm. They were introduced to the comprehensive bill on April 7(Just before recess) SOLELY due to efforts of IV, QGA, AAPI and the good staff at Brownback's office.
I have to point this out because by saying that "IV has not done anything besides media publicity" is not true and it discourages people who have spent hundreds of dollars of OWN money to travel to Washington DC and lobby for these amendments. On top of that, core group members HAVE taken UNPAID TIME OFF FROM THEIR WORK to travel to DC. These things are not easy to get done. Unfortunately there is a partisan env now in Senate and the Comp bill's future is uncertain but had that bill been passed in Senate, it would have had amendments that come from nowhere else BUT Immigration voice.
So please be kind to the group and have patience. H4 applicants have a bad situation, but there are some in our membership who have been laid off after 6th year and are looking to go back to India as their current employer would withdraw the pending labor. So these guys are GOING BACK to country of origin along with their H4 SPOUSES. Things could be a lot worse and one should be mindful that everyone has problems in their lives.

What are the tax implications for Aman or other recieving this. We dont want uncle sam to take a cut from something like this. Is there any CPA who can throw some light on this?
Maybe this money can be used to create an expense account which can reimburse Aman and others for their expenses. We got to convince the Core to let democracy in IV work one time to create this account.

If its TSC then I do not think it will help at all. Whenever I talk to IO their only response if they are waiting for availability at local ASC.

I do not think anyone should doubt the hard work and sincerity of illegal immigrants - be they mexican or any other nationality. All these folks come to USA seeking a better life. It is a fact that politicians have used illegal immigration to their advantage - how it suits them at a particular point in time. SO I do respect the hard working nature and contribution of illegal immigration.
However you will have to appreciate that the government's policy of grouping legal and illegal immigrants in any legistative decision has proven to be a nightmare for the legal immigrants. You will also appreciate that issues and circumstances surrounding legal immigrants are substantially different from illegal immigrant issues. However legal immigrants have to face the brunt of retrogression and other processing delays due to:
1) A nonsensical approach of first letting illegal immigrants to work here, not giving them their rights for long years or enforcing the laws to deport them and then suddenly legalizing the illegals, without improving INS/DHS processes or infrastructure/Visa quotas.
2) Prospects of another huge influx of legalization which as we all know, the INS is not capable of processing with its existing operational capabilities.
I am hopeful that whatever law emerges in the next year or two should handle illegal and legal issues separately. As far as xenophobia towards hispanics, everybody has their own view, so you cannot unfairly generalize that Indians have this racism towards mexican illegals. Personally, I do not have a problem with people expressing their ethnic identity, but as we know everybody need not think like us and everybody is entitled to an opinion.
Good luck and please continue to work for relief for legal immigrant community.

I applied for the first time in 2001, and then in 2005 (due to relocation) and ended up at the backlog center. Another relocation and now my PD is March 2007, and these recent wannabes want Perm approved in 1 month, I-140 premium processing in few days and then onto I-485 which should be current with no retrogression. Amen !! When do you want the USCIS to bend over for you?

This act is to be blamed partly for the present scenario of over-subscription of thousands of law abiding and tax paying highly-skilled workers, including engineers, scientists and health care professionals who have been waiting patiently for years in order to be eligible to apply for their Green cards.
USCIS's sudden backlog reduction efforts during the past month have resulted in the use of almost 60,000 Employment numbers among which 18,000 were used on June 30 (Saturday) and July 1st (Sunday) according to (Quote source).

Although there is no law that says you cannot obtain PR for any other country as long as your application for US PR is pending, you will be harassed when you tell them that you are in US on AOS. I opened SR in Jan...in Feb they sent letter that security checks are pending..so I took INFOPASS after talking with attorney...went to INFOPASS and was rudely told that it could take a long time because Namecheck is pending..no idea how long it will take...i was like..if security check is pending do my FP and check everything...but no...they want to do name check..okay..then attorney said to wait 1 more month...he called last week to USCIS and they said...oh we responded on FEB..to the original SR..the response was..its still pending..hell..i know that already..what the hell are u doing about it ?? i thought they were supposed to work on an SR and get it out of the way in 60 days..now lawyer is asking to wait 1 more month because he is saying 60 days from Feb...GOSH..and i am waiting for 140 also...filed in July went to NSC-TSC blackhole..God knows what will happen...

(e) Retention of section 203(b) (1), (2), or (3) priority date. A petition approved on behalf of an alien under sections 203(b) (1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b) (1), (2), or (3) of the Act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b) (1), (2), or (3) of the Act, the alien shall be entitled to the earliest priority date. A petition revoked under sections 204(e) or 205 of the Act will not confer a priority date, nor will any priority date be established as a result of a denied petition. A priority date is not transferable to another alien.

Did you change your mailing address after you submitted your I-485?
Some time they correspond to your old mailing address even though you updated the address with USCIS.
Did you check with your Attorney? Is the correspondence address given is your mailing address or Lawyers? Some times Lawyers give their address for correspondence to USCIS.
These factors count where the approved mail goes to. I am sure you might have checked these before. If you over-looked these, then these may be the areas that you have to check on.
My 2 cents.

I am happy to report that we got our approvals. No SMS, no emails, no status change. Infact, our online status still shows RFE review. We got welcome notices yesterday and that's how we came to know about approvals. Got LUD on an old H1B on 8/14/2010.

There was no discussion on invoking AC21 where the salary is lower than specified in LC. For example wages for LC filed in bay area will be higher than other places and if one wishes to move to work location where prevaling wages are lower compare with original LC location. What would USCIS position on this since AC21 does not talk about work location.
